RYLYF USERS – TERMS AND CONDITIONS

This Agreement governs your use of the Rylyf User Services, which include: (1) the Rylyf website at http://www.rylyf.com and all related sites owned by Rylyf (collectively, the “Rylyf Site”); (2) the appointment booking engine provided through the Rylyf Site and Rylyf mobile applications (collectively, the “Rylyf Application”); (3) payment services for beauty services made available by Rylyf Professionals through the Rylyf Application (“Rylyf Payment Services”), as detailed in Part II below; and (4) any other services or features provided to Rylyf Users through the Rylyf Site or Application. Collectively, these are referred to as the “Rylyf User Services”.

In this Agreement, “Rylyf” or “we” refers to Rylyf Technologies LLC, a company based in Pennsylvania, and “Rylyf User” or “you” refers to any person using the Rylyf User Services to book beauty services from Rylyf Professionals (“Rylyf Professionals”) through the Rylyf Site and Application.

By accessing or using the Services, you accept this Agreement (on behalf of yourself or the entity you represent) and warrant that you have the authority to do so. You may not use the Services if you are under 18 years old, except with the consent of a parent or legal guardian. Rylyf may update this Agreement periodically, and your continued use of the Rylyf Site or Application indicates your acceptance of any changes. If you do not agree with the terms, do not use the Rylyf User Services.



PART I – APPOINTMENT BOOKING

 

1)   Purpose and Functionality of Rylyf Booking Services

  • Rylyf offers its website (the “Rylyf Site”) and mobile applications (the “Rylyf Application”) as platforms for users (“Rylyf Users”) to connect with beauty professionals (“Rylyf Professionals”). Through these platforms, users can request appointments for a variety of beauty services.

  • Upon receiving a booking request from a Rylyf User, the system notifies the relevant Rylyf Professional. This notification allows the professional to view the request details, including the type of service, preferred date and time, and any specific instructions provided by the user.

  • Rylyf Professionals have the autonomy to accept or decline any booking request based on their availability, workload, and personal discretion. This ensures that professionals maintain control over their schedules and commitments.

 

2)   Availability and Scheduling by Rylyf Professionals

  • Rylyf Professionals have the flexibility to set their availability through the Rylyf Site and Application. They can specify the days and times they are open to accepting appointments, enabling them to manage their work-life balance effectively.

  • This feature allows professionals to update their availability in real time, accommodating changes in their schedules and personal commitments. Users can only book appointments within the available slots, ensuring that booking conflicts are minimized.

 

PART II - PAYMENT TERMS

 

3)   Credit/Debit Card Information Requirement

  • To facilitate seamless transactions, Rylyf Users must provide valid credit or debit card information through the Rylyf Application. This information is securely stored and used for processing payments for beauty services.

  • Users have the flexibility to manage their payment methods, including adding new cards, updating existing ones, or removing outdated information. This ensures that payment details are current and accurate, reducing the likelihood of transaction issues.

4)   Payment Processing Post-Service Confirmation

  • After a Rylyf Professional confirms the completion of an appointment, the user’s credit or debit card is immediately charged for the full amount of the service provided. This process ensures that professionals are compensated promptly for their work.

  • The transaction details, including the service provided and the amount charged, are documented in the user's account, providing transparency and a record for future reference.

5)   Cancellation Policy and Fees

  • Users can cancel their appointments without incurring any charges if done within the first ten minutes after a booking is confirmed. This grace period allows for quick corrections in case of accidental bookings.

  • Cancellations made between ten and twenty minutes after booking incur a fee of 50% of the total service cost. This fee compensates professionals for the potential loss of business and time.

  • Cancellations made more than twenty minutes after booking will result in a charge for the full service cost. This policy ensures that professionals are fairly compensated for the time and effort they have allocated to the appointment.

6)   Use of Third-Party Payment Processors

  • Rylyf collaborates with third-party vendors and service providers to handle payment processing. These partners are selected based on their compliance with security standards and their ability to protect user information.

  • By using the Rylyf Payment Services, users agree to the involvement of these third-party processors, subject to the terms outlined in Rylyf’s privacy policy. This collaboration ensures efficient and secure payment transactions.
     

PART III - GENERAL TERMS 

 

7)   Privacy Commitment

  • Rylyf is dedicated to protecting the privacy of its users. Detailed information about how user data is collected, used, and shared is available in the privacy policy. Users are encouraged to review this policy to understand their privacy rights and Rylyf's data handling practices.

8)   User Account Creation and Management

  • To access Rylyf User Services, individuals must create a Rylyf User Account by providing accurate and up-to-date personal information. This data, referred to as “Rylyf User Registration Data,” must be kept current to ensure effective communication and service delivery.

  • Users are responsible for the security and confidentiality of their account information. Any unauthorized access or suspicious activity must be reported to Rylyf immediately. Maintaining a single user account per individual is mandatory to prevent misuse.

9)   Use of GPS and Communication Standards

  • The Rylyf Application may utilize GPS technology to pinpoint the user’s current location, enhancing service accuracy and convenience. Users must consent to receiving SMS notifications related to their service bookings and updates.

  • Users are responsible for any charges from their mobile carriers related to the use of GPS and SMS services. These charges are beyond Rylyf's control and vary based on the user's mobile plan.

10)   Internet and Device Requirements

  • Accessing Rylyf User Services requires a stable internet connection. Users are responsible for any data or usage fees incurred through their mobile carrier when using the Rylyf Site or Application.

  • Rylyf does not guarantee compatibility with all devices or mobile carriers. Users should ensure their devices meet the necessary technical specifications to use the services effectively.

11)   Modification of Services and Pricing

  • Rylyf reserves the right to alter its services and pricing structures as needed. This includes adding, removing, or modifying features on the Rylyf Site and Application without prior notice.

  • Users who disagree with any changes have the option to discontinue using the services. Continued use of the Rylyf User Services indicates acceptance of the changes and satisfaction with the updated offerings.

12)   Intellectual Property Rights

  • All content provided through the Rylyf User Services, including text, graphics, and videos, is protected by intellectual property laws. Users are granted a limited, non-exclusive license to use this content solely for personal purposes related to the services.

  • Any unauthorized use of Rylyf Content or User Services constitutes a breach of this Agreement and may result in legal action. Rylyf retains all intellectual property rights, and no additional rights or licenses are granted to users.

13)   License to Use the Rylyf Application

  • Rylyf grants users a non-exclusive, non-transferable, revocable license to use the Rylyf Application on compatible mobile devices. This license is intended to support the user's permitted use of Rylyf User Services and may be revoked at any time for violations of the Agreement.

14)   Personal Use Only

  • The Rylyf User Services and content are intended for personal use only. Users are prohibited from commercializing or redistributing any aspect of the services without explicit permission from Rylyf.

  • Rylyf reserves the right to refuse service, terminate accounts, and take appropriate action against users who violate these terms or engage in prohibited activities.

15)   Termination of Services

  • Rylyf may suspend or terminate user access to the Rylyf User Services at any time, without notice, for any reason, including breaches of this Agreement. Suspended or terminated users may not be allowed to re-establish accounts or use the services again.

  • Users can discontinue their use of the services at any time. Account termination may result in the deletion of user content, and Rylyf is not liable for any loss of data.

16)   User Representations and Warranties

  • Users represent and warrant the accuracy of the information they provide and ensure that their content does not infringe on third-party rights. Users agree to indemnify and hold harmless Rylyf and its affiliates from any claims arising from their use of the services or breaches of this Agreement.

17)   Limitation of Liability

  • Rylyf Parties are not liable for any damages, including direct, indirect, incidental, or consequential damages, resulting from the use or inability to use the Rylyf User Services. This limitation of liability applies to the maximum extent permitted by law.

18)   Disclaimer of Warranties

  • Rylyf disclaims all warranties, express or implied, regarding the Rylyf User Services. This includes warranties related to the accuracy of information about Rylyf Professionals and the quality of services provided by them.

19)   Assumption of Risk

  • Users acknowledge that using Rylyf Professional services involves inherent risks, including potential dissatisfaction with the services provided. Users assume all risks associated with their use of the Rylyf Site, Application, and booking services.

20)   Reliance on Information

  • Users acknowledge that any information provided by Rylyf or Rylyf Professionals is used at their own risk. Users are responsible for verifying the qualifications and suitability of professionals they choose to book through the platform.

21)   Role of Rylyf

  • Rylyf facilitates the connection between users and professionals but does not provide the beauty services itself. Rylyf cannot guarantee the accuracy of professional information or qualifications and is not responsible for the actions or omissions of professionals.

22)   Statutory Rights

  • The disclaimers and limitations outlined in this Agreement apply to the maximum extent permitted by law. Users may have additional statutory rights that are not waived or limited by this Agreement.

23)   Essential Terms

  • The disclaimers, exclusions, and limitations in this Agreement are essential to the agreement between Rylyf and its users. These terms represent a reasonable allocation of risk and are intended to survive any failure of limited remedies provided herein.

24)   Severability

  • If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it enforceable.

25)   Assignment

  • Users may not transfer, assign, or delegate their rights or obligations under this Agreement. Rylyf may freely transfer, assign, or delegate its rights and obligations without restriction.

26)   Waiver

  • Any waiver of a provision of this Agreement or delay in enforcing rights shall not be deemed a continuing waiver or a waiver of any other provision. Rylyf's failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

27)   Arbitration and Dispute Resolution

  • Any disputes arising between users and Rylyf will be resolved through binding arbitration, as mandated by the Federal Arbitration Act. The arbitration process will be conducted by the American Arbitration Association (AAA) following its rules and procedures.

28)   Class Action Waiver

  • Users waive the right to bring any claims on a class, collective, or representative basis. All claims must be arbitrated individually, and users agree not to participate in any class or collective arbitration against Rylyf.

29)   Governing Law

  • This Agreement is governed by the laws of the State of Pennsylvania, without regard to conflict of law principles. This includes the Federal Arbitration Act, which governs the arbitration provisions within this Agreement.
     

 PART IV - TERMS AND CONDITIONS FOR SMS HELP MESSAGES
30)   Introduction:

  • By opting in and using SMS services provided by Rylyf Technologies LLC (DBA: Rylyf) (hereafter referred to as “we,” “our,” or “us”), you agree to the following terms and conditions regarding the handling of HELP messages sent via SMS. These terms apply to all SMS interactions initiated by or involving HELP commands.

31)   Service Description:

  • When you send the keyword “HELP” to our SMS number, you will receive an automated response with information about how to get support or access additional resources. Our SMS service is designed to provide assistance on matters related to your account, service information, or queries about our offerings.

32)   How to Opt-In:

  • By providing your phone number and agreeing to receive SMS communications from us, you agree to receive periodic text messages. These messages may contain service updates, promotional offers, and customer support information. You can always send “HELP” to receive assistance or contact information.

33)   HELP Command:

           When you text “HELP” to our SMS number, you will receive a message with:

  • A brief description of the available services.

  • Contact information to reach our support team (e.g., phone number, email).

  • Instructions for how to stop receiving SMS (using “STOP” keyword).

Please note that standard message and data rates may apply, depending on your mobile carrier and  subscription plan. For further details, consult your mobile carrier.

 

34)   Frequency of Messages

  • The frequency of SMS messages will vary based on your engagement with our services and may include periodic updates or alerts. You can control the frequency of these messages by opting out or customizing your preferences via the “HELP” command or other opt-in/opt-out mechanisms.
     

35)   Message and Data Rates

  • Your mobile carrier’s standard message and data rates may apply for any messages sent to or received from us. We are not responsible for any charges that you may incur as a result of using our SMS service, including HELP requests. Please check with your carrier for details on these rates.

36)   Privacy​

  • We are committed to maintaining your privacy. Information collected through our SMS service is governed by our Privacy Policy. By sending “HELP” or engaging with our SMS service, you consent to the collection, use, and disclosure of your information as described in our privacy policy.

37)   Opt-Out Instructions:

  • If you wish to stop receiving SMS communications from us, you can opt out at any time by texting “STOP” to our SMS number. You will receive a confirmation message and no further messages will be sent unless you re-enroll in the service.

38)   Supported Carriers:

  • Our SMS service is available on most U.S. carriers, but the availability of service may vary depending on the user’s mobile carrier. We are not responsible for any delays in message delivery or SMS services that are unavailable due to carrier issues.

39)   No Guarantee of Delivery:

  • We do not guarantee that SMS HELP messages will be successfully delivered or that you will receive an immediate response. Delays or failures in message delivery may occur due to issues beyond our control, including network congestion, carrier problems, or technical malfunctions.

40)   Changes to Terms:

  • We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting the updated Terms and Conditions on our website or providing notice to users through other means, including SMS notifications.
